Terms and conditions of engagement

From the start of your engagement with DPO Services, our team will: 

• Support you in all issues relating to the UK Data Protection Act 2018 in a friendly, practical, confidential and non-technical manner 
• Provide a detailed briefing with the school’s senior leadership team (SLT) on both the services we offer and current issues and trends in data protection  
• Use a variety of media to support you and provide you with the most up to date information on all aspects of Data Protection Act 2018. This includes by telephone, e-mail, video calls, and face to face meetings.
• Provide concise monthly updates to advise on current threats, changes in practice or legislation and areas of concern
• Provide advice on breaches and support drafting responses. Breaches must be reported to us immediately so we can advise on an appropriate response and draft this with you. We are available 24/7 for breaches and can advise on whether it should be reported to the ICO. It is often adequate to report it to us and we will log the breach on our records 
• Advise and draft responses where Subject Access Requests are received, including the level and amount of data you should provide if indeed necessary. It is sometimes the case that Subject Access Requests (SAR’s) are designed to frustrate or harass schools. Our advice can often reduce the time and energy you may have to spend on such matters 
• Advise on whether Freedom of Information (FOI) requests are genuine and the level of information you should respond with if they are 
• Advise on and provide draft policies, procedures and guidance 
• Advise on conflict resolution where complaints are unreasonably persistent and vexatious
• Liaise with the Information Commissioners Office on your behalf, guiding you on any responses required, and engage with the ICO for their advice on your responsibilities under the Data Protection Act 2018. 

In addition, at the rates detailed in this document, we will provide: 

• Bespoke training for school staff on the issues and trends of data protection, how to keep information safe and how to avoid common issues schools face regarding data protection  
• Bespoke training for SLT and school staff on all aspects of data protection  
• One on one training and/or coaching for individuals who may need upskilling
• Leadership coaching for head teachers and SLT members, tailored for each leader  
• Bespoke consultancy for advanced data protection support, compliance and policies, school improvement, early years specific quality improvement, and professional development and training on aspects outside of data protection.  

Pricing and billing 

DPO Services charges per pupil per annum. When you join the DPO Services family your initial face to face or online SLT briefing is free of charge. This session is designed for us to get to know each other and to answer your Data Protection Act 2018 questions in a non-technical and common-sense style. Please note: 

• All prices are VAT exclusive 
• Billing will begin from the day of commencement with DPO Services 
• Billing will occur via direct debit quarterly in advance  
• An invoice will be provided each quarter plus an annual statement  
• Additional training, coaching and consultancy services and agreed expenses will be invoiced monthly post engagement and paid by 15th of the following month. 

DPO Services  (all prices in GBP)

Schools up to 1500 pupils: 4.00 per pupil 

Schools over 1500 pupils: 4.00 per pupil capped at 6500 

Multi school academies and trusts: By negotiation  

Training, coaching and consultancy 

Training for groups – up to 2-hour session: 350.00 

Training or upskilling for individuals: 75.00 per hour 

Leadership coaching: 100.00 per hour 

Other coaching: 75.00 per hour 

Consultancy - pro rata as required: 600.00 per day plus agreed expenses 

Termination of services 

If a school wishes to end their engagement with DPO Services written notice is required. The agreement with the school will end at the end of the school’s next three-month cycle.  

Confidentiality 

Confidentiality, integrity and trust are integral to DPO Services ways of working. We take the protection of your school and personal data seriously and comply with the Data Protection Act 2018.  We keep all information confidential including all written information shared with us, information from other media, and our conversations. Any data or information relating to the business of the school, especially proprietary information, will be kept confidential, unless authorised by the school. At DPO Services we protect the reputation of schools engaged with us by ensuring no harmful information is shared with other parties.  DPO Services meets their legal obligations to provide information when required by law or by a court order.  

Indemnity 

The school is the data controller and remains liable for DPA 2018 non-compliance and breaches. The advice and guidance provided by DPO Services is intended to support schools to meet their responsibilities in the application of, and adherence, to the Data Protection Act 2018. Any advice and guidance provided by DPO Services reflects their current knowledge applied to the circumstances described by the school. DPO Services is not responsible for the misapplication of this advice and guidance.  

Governing Law 

This agreement will be governed by, and construed in accordance with English law and the UK Data Protection Act 2018.
